SINHA, J: QUESTION: Whether mammoth ivory imported in India answers the description of the words ivory imported in India contained in Wild Life (Protection) Act, 1972 (hereinafter referred to as the said Act) as amended by Act No. 44 of 1991 is the question involved in these appeals which arise out of a common judgment and order dated 20.3.1997 passed by a Division Bench of the Delhi High Court. FACTUAL BACKGROUND: The appellants M/s Unigems had imported mammoth fossil said to be of an extinct species in the year 1987. The stock of mammoth fossil held by the appellants is said to be periodically checked by the statutory authorities. The appellant in the other case Balram Kumawat is a carver. The appellants state that mammoth ivory is distinguishable by visual and non-destructive means visa- vis elephant ivory and even in Convention on International Trade in Endangered Species (CITES) their distinguishing features have been pointed out. As Mammoth is an extinct species and as what is being used for carving is its fossil which is called ivory because it has white and hard dentine substance which is also available in other 11 animals, namely, Whale, Walrus, Hippos and Warthog; it was urged, they cannot be included in the term ivory within the meaning of the provisions of the said Act. FINDINGS: In the connected matter in Indian Handicrafts Emporium Ors.Vs. Union of India Ors. (Civil Appeal No. 7533 of 1997) disposed of this date; this Court upheld the constitutional validity of the provisions of the said Act. This Court held that in terms of Sub-Section (7) of Section 49-C of the Act all persons in general and traders in particular have become disentitled from keeping in their control any animal article including ivory imported in India. This Court further held that as a logical corollary to the said finding, the statutory authorities would be entitled to take possession of such ivory in terms thereof; the purport and object of the Act being to impose a complete ban on trade in ivory. A complete prohibition has been imposed in the trade of ivory (whether imported in In dia or extracted by killing Indian elephants) for the purpose of protecting the endangered species. The purport and object of the Act, as noticed in the judgment in Indian Handicrafts Emporium (supra), is that nobody can carry on business activity in imported ivory so that while doing so, trade in ivory procured by way of poaching of elephants may be facilitated. The Parliament, therefore, advisedly used the word ivory instead of elephant ivory. For the purpose of determination of the question, only the dictionary meaning of the term ivory was considered. The object of the Parliament was not only to ban trade in imported elephant ivory but ivory of every description so that poaching of elephant can be effectively restricted. 12 G.R. Nos. 2750 of 1986 with 3586, 819 and 437 etc. etc. of 1987 and 207 of 1989 IN THE HIGH COURT OF DELHI ORDER In this case there are batches of writ petitions filed by the manufacturers, wholesalers and dealers engaged in retail trade of tanned, cured and finished skins of animals. Petitioners are also engaged in retail trade of articles made of skin, hereinafter referred to as the animal articles. The petitioners in the above writ petitions had challenged the introduction of provisions of Chapter VA in the Wild Life (Protection) Act, 1972 by Wild Life (Protection) Amendment Act 1986, together with notification issued hereunder as being violative of Article 19(1) (g) read with Articles 300 and 300A of the Constitution of India. The petitioners claim to have applied for licenses and were granted licenses in various categories and claim to have carried on their business as valid license holders. The schedule to the Act was amended in 1927 which included snake skin and the authorities stopped permission for export of snake skin. The impugned Act rendered joble ss the petitioners who carried on their legitimate trade, business and occupation, without any compensation. The petitioners, who had lawfully acquired skin and skin articles of animals already killed and had invested huge amounts of money, were deprived of their sources of livelihood. It resulted in extinction of fundamental rights of the petitioner under Article 19(1) (g). Court vides interim order made on 23-1-1987 permitted the petitioners to make the declaration of stocks. 13 The petitioners had been provided under the Act a period of two months to dispose of their stocks and as noticed above in fact as a result of petitions filed and orders passed, the petitioners have enjoyed the opportunity to sell for a period of nearly six years till February, 1993. Accordingly, the petitioners cannot have any legitimate grievance of denial of opportunity in this regard. Neither the State nor the Bharat Leather Corporation and the State Trading Corporation are under any legal obligation to buy the stocks of the petitioners in acceptance of the one time sale proposition advanced by the petitioners. The petitioners are also not entitled to any further time for disposal of stocks. The stocks of the petitioners would, therefore, be liable to be dealt with in accordance with the provisions of the Wild Life (Protection) Act, 1972. The provisions of Chapter V-A, introduced by the Amending Act of 1986 to the Wild Life Act of 1972 were held val id. Hence for the aforesaid reasons the writ petitions were dismissed. Discussion- Point here to be noticed is that India does not take long to abide law to any illegal activity but there is no authority to cross-check if the laws are strictly followed or not. Law is violated without fear and no stringent action is taken against it. The law ministry on Tuesday approved over 100 amendments in the Wildlife Protection Act, 1972, bringing it in tune with wildlife protection laws across the world by including regulation of species not native to India, a requirement under a global convention on wildlife. Environment minister Jairam Ramesh said the bill, which strengthens the powers of forest and enforcement agencies, will be introduced in the winter session of Parliament after getting the cabinets approval. To provide the highest degree of legal protection to the most vulnerable animals against poaching, the amendments have put tigers, whose population is said to be less than 1,411, in Category 1. Other endangered animals in this category inc lude lions, elephants, rhinos, crocodiles and antelopes. Killing an animal in Category 1 could attract a minimum jail term of five years and maximum of seven. The fine prescribed ranges from Rs 5 lakh to Rs 1 crore. Other posters warn against buying Shahtoosh shawls stating that for the making one shawl two or three Chirus are killed. Buying these shawls is a criminal offence and is punishable. According to wildlife law enforcers, around 250 tigers have fallen prey to Chands vicious demand for tiger parts. Dangamala Forest Range Officer Durga Charan Sahu said the three accused trapped a wild boar by entering illegally into the Kantika Forest block under the Bhitarkanika National Park.Later, they killed the wild boar and sold its meat at Talachua and Tikayatnagar. Acting on a tip-off, a forest team conducted raid and seized the cooked wildboar meat from the house of one Subala Singh of Talachua village. The three arrested people were later produced before the court which remanded them into jail custody after rejecting their bail petitions. The consequences have to be imprint into them so that their duty overheard their greed. 18 We need to change- Wildlife extinction is so connected with all eco-systems that a slight tilt in its balance causes unimaginable disturbances in our normal life we are the direct and indirect consumers of life. The change needs to come within us. We must understand and curb the ways in which we are contributing to the offence. Stop buying wildlife and wildlife parts and products made by using them. If there are no buyers, there will be no sellers and no poachers then. We must be a part of organizations who indulge in protecting the wildlife. We must educate people and spread awareness. We must report any instance of illegal trade that we come across. We must realize that these ecosystems have sustained mankind for so long. And now, its our turn to sustain it. 19

Throughout the book Katniss often finds herself making multiple references back to her friend, Gale, who has been her best friend for years. She wonders what life would be like with Gale. Katniss pretends to be in love with Peeta. She sees it as her only way of survival in the Games. When she and Peeta are in an affectionate state, the Capitol audience is entertained. This results in her and Peeta getting both food and messages from their mentor Haymitch and their sponsors. â€Å"Born on the Fourth of July† This book was incredible! In all truth this was the first book I have ever read cover to cover. The book, by Ron Kovic, as compared to the film, by Oliver Stone, had some impressive similarities. Both the book and the film did a great job of portraying Ron’s childhood in Massapequa, Long Island. From the little league games to playing war in the woods, leading charges and setting ambushes. This was especially well done in the movie, and exactly as I pictured them while reading the book. The time that he spent in Mexico was well defined in the book as well as in the film. While there were many similarities, what I feel is more important is to focus on the differences. There were countless small differences in the film as compared to the book, things such as shuffling the order in which chapters appeared in the film. For example, the beginning of the film took a different path than the beginning of the book. In the book the first chapter set the tone for the rest of the book, describing the firefight and all that had gone wrong, Burning into your mind the thought of Ron Kovic lying on the ground bleeding, paralyzed, screaming for help and hearing people get shot all around him. The beginning of the film is a different story all together. It gives you hope, it lulls you into believing that this is a happy story, the kind where everything always works out in the end. It is not until after the entire buildup of the character, after you feel as if you know him, that you see this scene. The accidental killing of the civilians, the baby, the killing of the corporal, all these things happen before you find out that this soldier, this Marine, will come hom e paralyzed. The film makes it a point to show that there was an on-going, pseudo romance between Ron and Joan Marfe. The two of them kissing on his birthday, Ron running to the prom and showing up soaking wet, asking her for a dance. Finding her after the war and going to a protest with her. None of these things were anywhere in the book, in fact the book only mentioned her once, and in that mentioning Ron said that he was always too nervous to ask her for a date. The film completely leaves out Ron’s marriage to Helen and his entire time in California. As for the reasons that Ron joined the Marine core there were some interesting and important differences. I found it reassuring that Toplin was more concerned about educating the reader that movies were a good thing for history, while they are not always completely accurate, they do expand the minds of the people viewing them. If it was not for â€Å"Pearl Harbor† or â€Å"Saving Private Ryan†, an entire generation could have forgotten about World War II. I would even go as far as to say that in 50 years there will be a movie such as â€Å"Pearl Harbor† about the terrorist attacks on the World Trade Center. Movies are an important part of our lives, they can be used as a teaching tool, or as a means of remembrance, but they will always be used. I just hope that the people watching them don’t take them as fact, but take them as a basis to learn more about what really happened.

The War Of Northern Aggression

Since the end of the American Civil War it has long been thought of as a war of freedom. The victorious Union declared that they were fighting to free the slaves in the South. However, in fact, the Civil War was actually a major breaking point in American History because it was really a power struggle between the old and the new. The new, just as it had done in the previous generations, was replacing the old and was using so called â€Å"justice† as its spearhead.This division, based upon several distinct factors, led to conflict and sectionalism within the country and ultimately started a war. The Southern states eventually seceded from the Union because of differences in cultural expansion, political beliefs, and authority. Culturally, the South and the North were almost always at odds. However, it didn’t escalate into a serious matter until the admission of California and a growing interest in the West.This expansion created the question of whether or not slavery was allowed in the West, and although many people thought that the conflict was solved with the Missouri Compromise, they were sadly mistaken (just ask the Native Americans and how compromises worked out with them). The truth of the matter was that the majority of Northerners didn’t really care if the South had slaves or not in the beginning. Odds are that the institution of slavery would had died out anyhow with no need for a war.However, if the nation was expanding and growing into a respectable country around the world, slavery was what many people believed was holding America back. This created tensions between the North and the South which often led to violent encounters such as the raid on Harpers Ferry led by John Brown, as well as violent disputes in the West, particularly in Kansas, over popular sovereignty which eventually led to the nickname â€Å"Bleeding Kansas. † With industrialism circulating in the North and new ties being made between the North and the We st due to advancements in railroads and transportation, along came with it a sense of superiority.The North was advancing along with the West, and the wicked South with all its impurities and old-fashioned traditions was holding the nation back. Although, what many Northerners couldn’t comprehend is that slavery was a necessary evil in the South. Slavery, along with technological advancements such as the cotton gin and short-staple cotton, were the main reasons for an influx of wealth in the region. In short, the livelihood of many Southerners was based on slavery and with the expansion in the West, and the question of slavery in the West, there was definite reason for Southerners to feel threatened.If people would fight to keep it contained then they would eventually fight to abolish it. In fact, in an excerpt from a speech given by Albert Brown he states that, â€Å"The Northerners hate us now, and they teach their children in their schools and churches to hate our childre n†¦. The John Brown raid, the burning of Texas, the stealthy tread of abolitionists among us, will tell the tale†¦. The North is accumulating power, and it means to use that power to emancipate your slaves (Doc 2).†This not only gives an example of how many Southerners felt threatened and infuriated but also shows the division of the country due to a prodding Northern agenda. Actually, in an excerpt from Jefferson Davis he said just that. He stated that, â€Å"Sectional hostility manifested in hostile legislation by states and raids of organized bodies sustained by Contributions†¦ of Northern Society furnish to us sufficient cause†, which basically means that Northern Society was backing Southern Society into a corner (Doc 7).Politically, the division between the two sections of the country was much greater than their already distant cultures. In fact, in the 1860 presidential election the popular vote was almost split right down the middle between the No rthern Republican, Lincoln, and the Southern Democrat, Douglas. Not only was it divided in numbers but as well as the different sections of the country almost exactly (Doc 4).In fact, during the presidential campaign in 1860 the Republican party stated that, â€Å"we deny the authority of Congress, of a territorial legislature, or of any individuals, to give legal existence to slavery in any territory of the United States† whereas the Democratic party stated that, â€Å"all citizens of the United States have an equal right to settle with their property in the Territory, without their rights, either of person or property being impaired (Doc 1)†, ultimately showing the reader the different opinions held by each half of the country.This gradual disunion of the country and its politics eventually led to a series of events, including the repeal of the Missouri Compromise and such abolitionist literature as Uncle Tom’s Cabin, that started a war. In a passage written b y George Templeton he reassured this when he said that, â€Å"we might have forgotten it had not Douglas undertaken to get Southern votes by repealing the Missouri Compromise. That was the final blow (Doc 5). †Despite the cultural and political differences of the war, to many people, it was about honor and integrity. The South felt as though the North had no right to tell it what it can and cannot do, and rightly so. Who were they to tell Southerners that after ages of building up their own Southern society and culture, they had to tear it down and conform to the rest of the country and its own beliefs and practices? In theory, the real reason behind the war was authority, and who exactly had it.Whether or not it was the pressure from the Federal Government to take control, or it was the states themselves who craved freedom from the government, or a combination of both didn’t matter because it was too far-gone at that point. However, the truth of the matter was summed up by a quotation from the Pittsburgh Press when it stated that, â€Å"The Republicans claim the right to make a code of laws for the South, not only in the States, but in the Territories (Doc 3).†This gives us the basis for what the war was truly about, which was the right to protect oneself and their way of life. So in conclusion, the Southern states seceded due to large differences in culture, politics, and faulty authority. This gave way to one of the bloodiest wars this country has ever seen with over half a million deaths on its own soil between its own countrymen. This tragedy led to resentment between both sections of the country, but allowed for the reestablishment of the Union to commence, giving way to the foundation of our present, somewhat unified country.
